The instant writ application has been preferred by the petitioner praying therein for the following relief:
For issuance of an appropriate writ (s), order(s) and/or direction (s) upon the respondent authority to publish the list of rest of candidates who got their physical test and verification of certificates after successfully qualifying in the written examination for recruitment to the post of constables with respect of Adv. No.- 04/15 to the district of Pakur.

The respondent-J.S.S.C. after receiving the aforesaid requisition started selection process for appointment on the post of Constables in different districts and also for appointment of constables in JAP and accordingly, Advertisement No. 04/2015 vide Annexure-1 of the writ application was issued by which applications were invited from the eligible candidates for
consideration of their candidature for appointment on the post of Constable against the advertised post.
4.
It is further evident from perusal of Clause-8(I) of Annexure-1 that no benefits of reservation would be extended to a candidate if it has not been claimed for by the candidate in his/her application form. Thereafter, after issuance of Advertisement, several candidates, including the petitioner, submitted their application forms before the J.S.S.C. for

2025:JHHC:25142 3 Pakur District in B.C-II Category.
The respondent-J.S.S.C., after receiving on-line application forms from the candidates, conducted the preliminary test examination, mains examination followed by Physical and medical fitness test and the Petitioner was declared successful in preliminary test examination and mains examination and as such he was also allowed to appear in Physical and medical fitness test.
Thereafter, the JSSC published the list of the shortlisted candidates for verification of the testimonials vide Annexure-6 of the writ application and the petitioner was also shortlisted and after verification of the testimonials of the successful candidates, JSSC published the final result on 08.03.17 for appointment of the successful candidates for District- Pakur and thereafter, JSSC also made recommendation for appointment of the successful candidates.
5.
It further transpires from the record that the Petitioner has secured 142 marks whereas last successful candidate in B.C- II Category for Pakur District has secured 175 marks and as such the petitioner was not declared successful for appointment on the post of constable.
Thus, it is evident that the petitioner has secured lesser marks than the last successful candidate in B.C-II Category in Pakur District and as such, he was not declared successful for the appointment.
