(Order on Substitution Application) This substitution application dated 10.05.2025 is filed with a prayer to substitute the legal heirs of appellant no.5 and to condone the delay in filing the substitution application. Learned counsel for the appellant submits that appellant no.5 died on 25.03.2020 during pendency of the present case. He further submits that appellant nos.1 to 4 are legal heirs of appellant no.5, therefore, he may be permitted to delete the name of appellant no.5 from the array of parties. Accordingly, the substitution application is allowed. Delay in filing the substitution application is hereby condoned. Learned counsel for the appellant is permitted to do necessary amendment in the memo of the appeal, as prayed. (Order on Appeal) This appeal is taken up today in the National Lok Adalat organized in the High Court Lucknow Bench premises. The parties appeared and they agreed to get the appeal decided in terms of compromise, which shall form part of award. Appellant nos.1 to 4 will get Rs. 1,00,000/- (one lakh only), without any interest in addition to awarded amount already deposited by the respondent no.3. The respondent no.3 shall ensure the making of compromised award good before the Tribunal below within 60 days from the date of receipt of copy of this order. If the said amount or part is already deposited in the Court, then the appellant nos.1 to 4 shall also be entitled for the entire interest of MACT Bank account as per Rule on the deposited amount.
