Court No. - 9 Case :- CRIMINAL REVISION No. - 681 of 2025 Revisionist :- Deepak Misra Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. And 2 Others Counsel for Revisionist :- Suyash Misra,Virendra Mishra Counsel for Opposite Party :- G.A. Hon'ble Pankaj Bhatia,J. Vakalatnama filed by Ms. Nisha Srivastava, Advocate on behalf of the opposite parties no. 2 and 3 is taken on record. Heard learned Counsel for the revisionist and Ms. Nisha Srivastava, learned Counsel appearing for the opposite parties no. 2 and 3. This revision has been filed challenging the order dated 02.05.2025, whereby a maintenance of Rs. 15,000/- has been granted to be paid to the respondent no. 3 herein i.e. the daughter of the revisionist. The contention of the Counsel for the revisionist and the respondents is that on account of marital discord, litigation is going on in between the parties, however, the order impugned awards maintenance only in so far as it relates to the daughter. After mediation in between the parties, the parties have agreed that this Court may award appropriate maintenance keeping in view the welfare of the child. It is stated that the child is aged about 6 years and is studying in a primary school in Class - Ist and a fess of Rs. 7,900/- per month is being paid with a further amount sustained on transport to and fro to school. It is admitted that both the parents, the revisionist as well as the respondent no. 2 are themselves teachers in Government schools. Considering the narrow dispute in between the parties, the order dated 02.05.2025 is modified to the extent that instead of Rs. 15,000/- fixed in the impugned order, the amount is reduced to Rs. 12,000/- per month, however, all the other conditions shall remain as it is. The balance amount out of the amount of Rs. 7500/- awarded and mentioned in the order dated 02.05.2025 shall be deposited by the revisionist in a Fixed Deposit account in a nationalized bank in the name of the respondent no. 3. This revision stands disposed of in the aforesaid terms. Order Date :- 27.6.2025/Lokesh Kumar Digitally signed by :- LOKESH KUMAR High Court of Judicature at Allahabad, Lucknow Bench
