JUSTICE SANJAY KUMAR DWIVEDI ----- For the Petitioner : Mr. Pradeep Kumar Prasad, Advocate For the State : Mrs. Priya Shrestha, Spl.P.P. ----- 06/20.08.2025 The petitioner is apprehending his arrest in connection with G(f) Case No.2111/2023, registered for the offence under Sections 33/41/42/52 of the Indian Forest Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Hazaribagh. 2. Learned counsel for the petitioner submits that the petitioner is neither the owner nor driver of the alleged tractor and the allegations are made that from one of the tractors, Shal wood of the Forest Department has been recovered. He further submits that the allegations are also made that the petitioner along with one Bijay Ram has fled away from the spot. He submits that the said Bijay Ram has been granted anticipatory bail in A.B.A. No.4100 of 2025. 3. Learned counsel for the State opposed the prayer and submits that the allegations are there of carrying Shal wood and in view of that, this application may kindly be dismissed. 4. Considering that one of the co-accused has been granted anticipatory bail in the aforesaid A.B.A. and the petitioner is neither the owner nor the driver of the alleged tractor and in the attending facts and circumstances of the case, I am inclined to extend privilege of anticipatory bail to the petitioner. 5. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hazaribagh in connection with G(f) Case No.2111/2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
