2025:JHHC:15612 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 3276 of 2025 ------ 1. Aslam Ansari @ Aslam, aged about 50 years; 2. Alim Ansari, aged about 41 years; Both are sons of Hakim Ansari @ Hatim Ansari, residents of Bara Mandansahi, P.O. & P.S.-Sahebganj, District-Sahebganj … … Petitioners Versus The State of Jharkhand. … … Opposite Party ------ CORAM: SRI ANANDA SEN, J. ------ For the Petitioner(s): Mr. Vikas Kumar, Advocate. For the State : Mr. Mohua Palit, A.P.P. ----- 04/ 16.06.2025 Heard the parties. 2. This anticipatory bail application under Section 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been preferred by the petitioner apprehending his arrest for offences registered under Sections 126(2), 115(2), 117(2), 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 in connection with Jirwabari P.S. Case No. 169 of 2024 pending in the Court of learned Chief Judicial Magistrate at Sahibganj. 3. There is direct allegation against the petitioner in the FIR of assaulting the informants. The impugned order also suggests that there were serious injuries on the eyes and the occipital region. 4. Learned counsel for the petitioner submits that this is a false case and the wife of the petitioner has also filed the complaint against the informant. 5. On the query, learned counsel submits that the case filed by the wife of the petitioner is after taking place of the 2025:JHHC:15612 2 occurrence. This clearly suggests that only to save her husband, the petitioner’s wife has filed the said complaint. 6. Considering the direct allegation and nature and the fact of the case this Anticipatory Bail Application stands dismissed. (ANANDA SEN, J.) Rashmi/Cp-3
