For Petitioner : Mr.P.Santhana Krishnan, For Respondent : Mr.P.Thilak Kumar (R1-R3 & R5) Government Pleader : Mr.A.Mohamed Hammed (R4) 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.18204 of 2020 O R D E R [Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted to direct the respondents 1 to 3 to remove the unauthorized well made by the fourth respondent in Amaravathi River, in S.No.1230C, Kodanthur South Village, Aravakurichi Taluk, Karur District in the light of the letter issued by the third respondent, dated 09.11.2019 and subsequent representation made by the petitioner dated 04.02.2020. 2.The learned Counsel for the petitioner would submit that out of ten illegal wells constructed by private individuals, nine wells are removed and one construction alone is to be removed. 3.The learned Government Pleader would submit that all the unauthorised wells are removed already. 4.In view of the same, the third respondent is directed to conduct an inspection and ensure that all the unauthorised constructions are 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.18204 of 2020 removed and the river water is preserved in the manner contemplated under the Act and Rules. 5.The learned Counsel for the contesting respondents would submit that the petitioner is also extracting river water illegally. 6.The said fact is also to be verified and appropriate actions if necessary shall be taken. 7.With the above directions, the writ petition stands disposed of.
