Heard the parties.
2.
This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest, for offences under Sections 406 and 420 IPC.
3.
As per the F.I.R., the informant received a phone call as she had applied for the post of Teacher in the Kasturba Gandhi Residential School. The caller asked the informant to collect the appointment letter by paying Rs.30,000/-. It has been mentioned in the F.I.R. that the informant deposited Rs.30,000/- in the Bank Account No.921020038295986, of the Axis Bank, but the appointment letter was not given, thus, she was cheated.
4.
Learned counsel representing the petitioner submits that the petitioner is not named in the F.I.R. His name transpired on the basis of the statement given by Vikram Kumar, who is the account holder of Bank Account No.921020038295986. Vikram Kumar, stated that this petitioner had taken his Aadhaar Card, PAN Card and called him to Pune, on the pretext of providing job.

5.
Learned A.P.P. representing the State opposes the prayer for anticipatory bail.
6.
After hearing the parties, I find that admittedly the amount was deposited in the account of Vikram Kumar and not in the account of this petitioner.
7.
Considering the aforesaid fact, I am inclined to allow this application.
8.
Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Koderma P.S. Case No.242 of 2021, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
