Heard learned Counsel Mr. A.A.R.Karim for the petitioner Khairuz Zaman who has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind bars since 01.06.2025 in connection with Patacharkuchi PS Case No. 111/2025 under Sections 105/281 of the BNS,2023. Mr. P.Borthakur, learned Addl.Public Prosecutor appearing for the respondent State has raised serious objection in granting bail to the petitioner by stating that the impact of the accident clearly reveals that the vehicle was driven in a rash and negligent manner and the eye witnesses had clearly indicated that the petitioner wa driving the vehicle in a negligent manner. 3. Per contra, it is submitted on behalf of the petitioner that petitioner is innocent and the accident was unintentional as the incident was an accident. 4. I have considered the submissions at the Bar. 5. I have also scrutinized the Case Diary. There are indeed incriminating materials in the Case dairy against the petitioner. However, the petitioner is willing to co-operate with the remaining part of investigation and to abide by any stringent conditions if imposed upon him. 6. It appears that bail may be granted to the petitioner. 7. The petitioner named above shall be released on bail on furnishing bail bond of Rs.30,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Bajali subject to the following conditions: i) That the petitioner shall refrain from committing any such activities of which he is alleged, ii) That the petitioner shall appear before the I.O. every fortnight till completion of the investigation,
8. On breach of any of the above conditions, learned court is at liberty to immediately cancel the bail granted to the petitioner. Page No.# 3/3
9. In terms of the above observations, the bail application stands disposed of. 10.
