And Others Counsel for Petitioner :- Sushil Kumar Singh,Raghvendra Singh Counsel for Respondent :- G.A. Hon'ble Pankaj Bhatia,J. Hon'ble Kshitij Shailendra,J. 1. Heard learned counsel for the petitioner and learned A.G.A. for the State. 2. The present writ petition has been filed by the petitioner seeking a direction for fair investigation of first information report No. 92 of 2025, under Sections 190, 191(2), 115(2), 351(3), 352, 318(4), 338, 336(3), 340(2), 61(2) BNS 2023, Police Station Itiathok, District Gonda. 3. It is argued that one of co-accused Sudhanshu Upadhyay had approached this Court by filing Criminal Misc. Writ Petition No. 4512 of 2025, in which he was directed to file an affidavit, however he has not filed the same. On the said ground, it is argued that co-accused Sudhanshu Upadhyay has already been arrested, however the other co-accused have not been arrested. 4. Considering the submission made, prima facie, there is no reason to form an opinion that the investigation will not be done fairly. 5. The instant writ petition is disposed of with a direction to the police authorities to conduct the investigation fairly and in accordance with law.
