CORAM:HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE
ORDER 28-11-2025
1. By the present petition, the petitioner alleges non-compliance of order dated 27.04.2022 passed by the Hon’ble Division Bench of this Court in OWP No. 1167/2015. The writ petition had been disposed of with a direction to the respondents to ensure payment of compensation as settled by the Collector for the land acquired in favour of the land owner/petitioner, and the compensation was directed to be released expeditiously.
2. The compliance report/statement of facts stands filed by the respondents, wherein it is stated that the compensation for the proprietary land has been disbursed to the petitioner as per the rates decided by the Private Negotiation Committee (PNC), i.e., Rs. 4.5 lakhs per kanal. However, in respect of the remaining land measuring 01 Kanal 10 Marlas covered under Survey No. 1132 (Shamilat Deh), the compensation has not been released, as the petitioner is neither recorded as a tenant in the Girdawari of 1971 nor till the acquisition of the land, which was initiated in 2014, as reflected in the Revenue Records.
3. In light of the stand taken by the respondents in the compliance report/statement of facts, the judgment/order dated 27.04.2022 passed by the Hon’ble Division Bench of this Court in OWP No. 1167/2015
stands complied with. No fruitful purpose would be served by keeping this petition pending.
4. Accordingly, the proceedings in the present petition are closed. Rule, if any, stands discharged.
