1. Proceedings of this matter have been taken through video conferencing. 2. Heard Dr. Arpit Lal, learned counsel for the petitioner and Mr. Sangharsh Pandey, learned Government Advocate, appearing for the State/respondents. 3. The present petition has been filed by the petitioner with the following relief(s):
“10.1 That this Hon'ble Court may kindly be pleased to club both the FIR bearing Crime No. 07/2025 registered at Police Station - Khamtarai, District - Raipur (C.G.) and Crime No. 05/2025 registered at Police Station Dharsiva, District Raipur (C.G.). 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondent authorities that both the offence is to be investigated together by the police officer of Police Station - Khamtarai, District Raipur (C.G.). 10.3 That, this Court many kindly be pleased to direct the respondent authorities to complete the investigation fairly and expeditiously in accordance with law. 10.4 That, any other writs and direction which this Hon'ble Court deems fit and just in the facts and circumstances of the case, may kindly be granted to the petitioner.”
4. On perusal of the prayer in the present petition, it transpires that the present petition is drafted with the relief which is defective one, therefore, we are not
3 inclined to entertain the present petition with such a vague and sketchy prayer as there is no mention of the offence in the relief clause and date under/on which the FIR has been registered.
Further, there is also no mention of the date on which the charge-sheet was submitted before the trial Court and the offences, to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with a liberty to file afresh petition with proper prayer/relief. 5. Learned State counsel has no objection. 6. In view of the submission made by the learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court and submit a receipt of the same at the time of filing of the fresh petition, if any, and the amount so deposited, if any, shall be transmitted to the Government Special School for Visual & Hearing Impaired, Bilaspur. 7. Certified copy of the FIR, charge-sheet and other documents may be returned back to the petitioner after retaining a photocopy of the same. Sd/- Sd/-
