Instagram, etc., which do not attract any offenses under the Indian Penal Code, 1860 or the Information Technology Act, 2000 (b) in trying to open a Rowdy Sheet against the Petitioner contrary to the rules contained in the Police Manual/Standing Orders (c) in calling the Petitioner to the Police Station and detaining him without there being any Crime/ FIR registered being illegal, unlawful, arbitrary, without jurisdiction, vitiated by bias, violative of Articles 14, 21 and 22 of the Constitution of India and consequently direct the Respondent Police not to call the Petitioner to the police station without any case registered and pass

ORDER:
The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
“....to issue a writ, order or direction, more particularly one in the nature of WRIT OF MANDAMUS Declaring the action of the Respondent Police (a) in trying to register Crime/FIR against the Petitioner on the same cause forming the basis for the earlier Complaint, dated 16/09/2019 or similar complaints lodged by the Respondent MLA or the Sixth Respondent or anyone based on the posts allegedly circulated by the Petitioner in social media including Facebook, Whats App, Twitter, Instagram, etc., which do not attract any offenses under the Indian Penal Code, 1860 or the Information Technology Act, 2000 (b) in trying to open a Rowdy Sheet against the Petitioner contrary to the rules contained in the Police Manual/Standing Orders (c) in calling the Petitioner to the Police Station and detaining him without there being any Crime/ FIR registered being illegal, unlawful, arbitrary, without jurisdiction, vitiated by bias, violative of Articles 14, 21 and 22 of the Constitution of India and consequently direct the Respondent Police not to call the Petitioner to the police station without any case registered and pass ...”
Learned Assistant Government Pleader for Home on instructions would submit that in the light of the interim order passed by this Court on 23.07.2020 , no further orders are necessary in this Writ Petition.
