T V S KUMAR 2 The Court made the following ORDER: This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: “….to issue an order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 15t respondent in notifying the post of Telugu Pandit Grade -I ( School Assistant- Telugu) to fill up the same by direct recruitment, vide Advertisement dated 16.5.2017 is in violation of Rule 12 (2A)(i) of A.P.Education Institutions (Establishment, recognition, administration and Control of Rules under Private Managements) Rules, 1993 issued under G.O.Ms.No.1, Education (P.S.2) Department dt.1.1.1994, orders issued at Para 7 (4) of G.O.Ms.No.75, School Education (P.S.2)Dept. dt.23.09.2002 and in Memo.No.18836/SE.PS/ AI/2012dt.16.12.2016 and Memo.No.19375/ PS/AI/2012 dt.1.2.2017 instead of filling the said post by promotion as per the said provision, as illegal, arbitrary, unfair, unjust, contrary to the rules and orders issued by the Government from time to time and consequently direct the respondents to consider case of the Petitioner for promotion to the post of Telugu Pandit Grde-I ( School Assistant-Telugu) in terms of the above rules and orders of the Government with all consequential benefits….” 2. On 01.09.2025, there was no representation for the petitioner. Hence, the matter was directed to be listed today under the caption „for dismissal’. 3. Today also, despite the matter being listed under the caption „for dismissal‟, none appeared for the petitioner. From this, it appears that the petitioner is not interested in pursuing the matter. 3 4. Accordingly, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs.
