The writ petition under Article 227 of the Constitution of India has been filed by the petitioner directing the learned Court below/Presiding Judge to expeditiously decide Revenue Case No.22/08 of 2022, Azaib Singh vs. Sinder Singh & Others” filed by the petitioner under Section 176 of the Uttar Pradesh Zamindari Abolition Act pending before the court of Assistant Collector 1st Category, Rudrapur, District Udham Singh Nagar. Further prayer has been made directing the learned court below/Presiding Judge to hear the pending matter on day to day basis. 2. The present matter relates to the partition of land. On perusal of the order sheet it reveals that on most of the occasions there was Bar Resolution passed by the Advocates and on some dates private respondents sought time for filing objection. 4. Learned counsel for the Petitioner prayed that direction be issued to the learned court below to expedite the proceedings of Revenue Case No.22/08 of 2022, Azaib Singh vs. Sinder Singh & Others. 5. I have considered the submission of learned counsel for the parties and have gone through the order sheet. By considering the facts and circumstances, this Court is of the view that trial should be expedited. The instant writ petition is disposed of with direction to the Assistant Collector 1st Category, Rudrapur, District Udham Singh Nagar to expeditiously decide Revenue Case No.22/08 of 2022, Azaib Singh vs. Sinder Singh & Others” expeditiously. It is provided that the court concerned shall not grant unnecessary adjournment to either of the parties.
