Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on record. 2. Petitioner is seeking to enlarge him on bail in Crime No.94/2024 of City Market Police Station, Bengaluru City, registered for offences punishable under Section 380, 454 and 457 of IPC. 3. Regarding theft of gold and silver jewellery, cash of Rs.32,00,000/- and other valuables, one D.V.Kantharaju lodged a complaint with the Police, based on which the aforementioned crime was registered against unknown persons. It is averred in the complaint that the complainant is running a jewellery shop at No.11/12, G.K.Lane R.T.Street Cross, BVK Iyengar Road, Chickpet. On 13.06.2024 at about 9.30 p.m., he closed the shop and went home. On the next day i.e., on 14.06.2024, when he

opened the shop at about 12.45 p.m., he noticed that some culprits had broke open the locker and taken away gold items weighing 2.5 Kgs and silver items weighing 9 kgs, Cash of Rs.32,00,000/-, diamond, pearls and other valuables. 4. Apprehending his arrest, petitioner approached the Sessions Court seeking anticipatory bail in Crl.Misc No.9410/2024, which was dismissed on 24.10.2024. Hence, he is before this Court. 5. It is contended by the learned counsel that the petitioner is innocent and police are making hectic efforts to arrest him in this case. He contended that petitioner is no way concerned with the alleged offence, his name is Himmat Singh and not Himandra Singh as mentioned in the remand application. Only on the basis of the statement of the co-accused he has been falsely implicated in this case. It is his further submission that accused Nos.2 to 6, 9, 10 and 12 have been enlarged on bail by the learned Sessions Judge. Petitioner is ready and willing to abide by

any conditions. Accordingly, he has sought to allow the petition and enlarge the petitioner on bail. 6. The prayer for bail is opposed by the learned High Court Government Pleader contending that, huge quantity of gold and other valuables have been stolen from the shop of the complainant and there are recoveries to be effected from the petitioner.
He contended that the petitioner is the mastermind and if he is released on anticipatory bail, he may not cooperate with the investigation of the case. He has accordingly sought to dismiss the petition. 7. The contention of the learned counsel that the name of the petitioner is Himmat Singh and not Himandra Singh as stated in the remand application and therefore, he is innocent etc., cannot be accepted at this stage. Grant of bail to other accused are also not a ground to enlarge the petitioner on anticipatory bail, as the said accused are enlarged on regular bail after their arrest and interrogation. - 5 -

8. It is submitted by the learned High Court Government Pleader that about 1780 grams of gold and cash of Rs.21,00,000/- have to be still recovered. Petitioner hails from the State of Rajasthan. If anticipatory bail is granted, that will come in the way of custodial interrogation of the petitioner. In the facts and circumstances, petitioner is not entitled for anticipatory bail.
