P.P. …..... 05/03.07.2025: This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Section(s) 316(5) BNSS-2023. 2. Heard the parties at length and had gone through the documents, annexed along with this application. 3. Opportunity was given to the State to oppose the bail, which the State availed and opposed. 4. The petitioner was working as Junior Engineer and he was provided fund for making construction. It is alleged that the petitioner has not submitted the accounts and the documents in respect of amount, which he spent. 5. The counsel for the petitioner submits that the petitioner has already superannuated way back in the year 2014. He submits that in the entire service career, there was no complaint about non-submission of documents and bills. He also submits that he has been given 3rd MACP in 2015 then also there was no complaint against the petitioner. Now suddenly, for the reasons best known, only to deprive of the petitioner from the retiral benefits, this FIR has been lodged. 6. Counsel for the State submits that the petitioner did not submit the bills and vouchers in respect of spending of Rs.23,81,151/-. 7. Admittedly, the petitioner superannuated in the year 2014 and this FIR has been lodged in the year 2024. At the time of superannuation, there was no departmental proceeding against the petitioner. He was granted all service benefits including 3rd MACP and there was no objection at any joint of time and none raised issue against the petitioner for non-submission of bills. Only in the year 2024, this allegation has been levelled that too for a work, which was allotted to him in the year 2007. 8. In view of the aforesaid facts, I am inclined to allow this anticipatory bail application. Accordingly, the petitioner, above named, is directed to surrender before the court below within four weeks from today and in the event of his surrender/arrest, the court below is directed to enlarge him on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Dumka in connection with Dumka (Muffasil) P.S. Case No. 115 of 2024, subject to condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property with further condition that the petitioner should cooperate with the investigation by appearing before the Investigating Officer once in every fifteen days till submission of final form.
