By way of instant application, prayer has been made on behalf of applicant/petitioner for release of amount lying deposited with the Registry of this Court. No reply is intended to be filed on behalf of non- applicants/respondents. It is not in dispute that in terms of judgment dated 30.05.2019 passed by this Court in CMPMO No. 253 of 2019, non-applicant/respondents, after having considered the case of the petitioner in the light of judgment dated 28.08.2018 rendered by Coordinate Bench of this Court in CMPMO No. 355 of 2015 titled Kam Raj & Ors. Vs. State of Himachal Pradesh & Ors., have deposited the enhanced amount in the Registry of this Court. Since judgment, as detailed hereinabove, has attained finality and in fact, has been implemented by non- applicants/respondents by depositing the enhanced amount, there appears to be no impediment in accepting the prayer made in the application and accordingly, the same is allowed. Registry is directed to release the enhanced amount in favour of the applicant/petitioner by remitting the same in his saving bank account, as detailed in para 6 of the application, subject to verification by the Accounts Branch of this Court.
