Neutral Citation No. - 2025:AHC-LKO:36835 Court No. - 18 Case :- WRIT - A No. - 6855 of 2025 Petitioner :- Manjula Devi Respondent :- State Of U.P. Thru. Prin. Secy. Bal Vikas Sewa Evam Pustahar Vibhag Lko. And 7 Others Counsel for Petitioner :- Daya Shankar Tiwari,Aditya Pandey,Manju Sonkar Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. Heard learned counsel for petitioner and learned State Counsel for opposite parties 1 to 7. Petition has been filed seeking a direction to concerned authority to select and appoint petitioner on the post of Aganbari Karyakatri at Mahsi (Gramin) in district Bahraich and for payment of honorarium regularly. Further prayer for a direction to concerned authority to scrutinize the legality and validity of documents submitted by opposite party No.8 has also been sought. Learned State Counsel on the basis of instructions however sbumits that petitioner applied for the said post in the above poverty line category whereas the opposite party No.8 (Smt.Pooja wife of Saket) applied under below poverty line category and resolution in her favour was passed whereafter she was appointed on the said post. Considering aforesaid submissions, it is evident that there does not appear to be any resolution in favour of petitioner, which in fact was in favour of opposite party No.8 who has also been subsequently appointed. In such circumstances, a writ seeking merely Mandamus would not be maintainable. In view of aforesaid, the petition not being maintainable is dismissed leaving it open to the petitioner to agitate her cause in appropriate proceedings with appropriate prayer.
