Rakesh Kainthla, Judge (oral) During the course of hearing, it has been pointed out that the offences punishable under Sections 451, 323, 506 read with Section 34 of Indian Penal Code (IPC) are compoundable under Section 320 of Cr.P.C.; hence, in this circumstances, learned counsel for the petitioner has submitted that he may be permitted to approach the learned Trial Court to seek the composition of the offences under Section 320 of Cr.P.C. Since, the offences are compoundable, therefore, the petitioner is permitted to withdraw the present petition and to approach the learned Trial, who shall decide the matter as per the law.
2. In view of the above, the present petition is dismissed as withdrawn with liberty as prayed for, so also the pending miscellaneous application(s), if any.
