No. 2 : in person Order No. 05 Dated: 08.08.2025 The present C.M.P. has been filed for restoration of W.P.(C) No. 1990 of 2022 which stood dismissed for non- compliance of order dated 22.02.2023. 2. Learned counsel for the petitioner submits that the petitioner had earlier filed C.M.P. No. 790 of 2023 seeking restoration of the aforesaid writ petition which was ordered to be restored vide order dated 02.02.2024 passed by a Co- ordinate Bench of this Court subject to the condition that the defects pointed out by the office in the writ petition would be removed within a period of three weeks, failing which the said order of restoration was not to be given effect to. It is further submitted that since some of the defects lying in the writ petition could not be removed within the said period of three weeks from the date of passing of the order, the writ petition could not be restored. Under the said circumstance, the petitioner has filed the present C.M.P. 2025:JHHC:22705 3. Having heard learned counsel for the parties and for the reasons stated in the present C.M.P., W.P.(C) No. 1990 of 2022 is restored to its original file and stage, subject to the condition that the petitioner removes the remaining defect(s) pointed out by the office by 26.08.2025 and pays a cost of Rs.5,000/- to the opposite party no. 2 within the said period. 4.
