1. Heard the learned counsel for the petitioner and
learned counsel for the State. 2. This anticipatory bail application has been filed by the petitioner apprehending his arrest for the offences under Sections 175, 379 and 414 of the Indian Penal Code and under Section 04/54 of Jharkhand Mineral Rules 2004 and under Section 07/09 of Jharkhand Minerals (Prevention of Illegal Mining) Transportation and Storage Rule 2017. 3. It is submitted that two other co-accused persons namely Rekha Devi and Prawin Kumar @ Pravin Kumar have been granted Anticipatory Bail by the another Co-ordinate Bench (Hon’ble Mr. Justice Anil

Kumar Choudhary) of this Court vide order dated 07.11.2023 in A.B.A. No. 8361 of 2023. 4. Learned counsel for the petitioner has further submitted that the co-accused Somnath Singh has been granted Anticipatory Bail in A.B.A. No. 4682 of 2024 vide order dated 16.08.2024 by the Co- ordinate Bench (Hon’ble Mr. Justice Rajesh Kumar) of this Court. 5. Learned counsel for the petitioner has further submitted that petitioner is the owner-cum-driver of the vehicle and he will co-operate during investigation. It is submitted that petitioner is ready to co-operate with the investigation of the case and also undertakes to furnish sufficient security including cash security and hence, the petitioner may be granted Anticipatory Bail. 6. Learned counsel for the State has opposed the prayer. 7. It appears that two other co-accused persons namely Rekha Devi and Prawin Kumar @ Pravin Kumar have also been granted Anticipatory Bail by Co-ordinate

Bench (Hon’ble Mr. Justice Anil Kumar Choudhary) of this Court vide order dated 07.11.2023 in A.B.A. No. 8361 of 2023. It further appears that the co-accused Somnath Singh has been granted Anticipatory Bail in A.B.A. No. 4682 of 2024 vide order dated 16.08.2024 by the Co-ordinate Bench (Hon’ble Mr. Justice Rajesh Kumar) of this Court. 8. Considering the facts and circumstances of the case and the fact that three co-accused namely Rekha Devi, Prawin Kumar @ Pravin Kumar and Somnath Singh have already been granted Anticipatory Bail, this Court is inclined to grant the privilege of Anticipatory Bail to the petitioner namely, Abdul Karim Ansari. 9.
Under the circumstances, the petitioner Abdul Karim Ansari is directed to surrender before the Court below within four weeks from today and in the event of arrest by the police or surrender within a period of four weeks from the date of this order, the petitioner, Abdul Karim Ansari shall be released on

bail on furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sahibganj/or his Successor Court in connection with Mirzachouki P.S. Case No. 26 of 2023 subject to the condition that the petitioner will co-operate with the Investigation of the case and will appear before the Investigating Officer as and when noticed by him and will submit mobile number and photocopy of Aadhaar card at the time of surrender in the Court below with an Undertaking not to change mobile number during the pendency of the case along with the other conditions laid down under section 438 (2)Cr. P.C.
