The present applicant “Suresh Chandra” is seeking bail in relation to First Information Report dated 29.11.2024 bearing FIR No. 377 of 2024, P.S. Khatima, District Udham Singh Nagar, wherein, the applicant has been implicated for the offence punishable under Section 118(1) and Section 351(2) of BNS, 2023. 5. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and there was a long civil dispute of some money transaction. He submits that there is a delay of 3 days in lodging the First Information Report and the applicant is in judicial custody since 09.04.2024 and have no previous criminal history. 6. The prosecution filed the counter affidavit and in the counter affidavit the statement of the injured is also enclosed along with the photographs including the statement of the Doctor, who has given medical treatment to the injured and as per the statement of the Doctor the injuries caused to the injured were grievious in nature and danger to life. 7. After hearing the arguments of the learned counsel for the parties and after gone through with the injury report as well as the statement of the injured and the Doctor, this court is of the view that the applicant is not entitled for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the bail application is rejected. (Rakesh Thapliyal, J.) 21.02.2025 PR 2025:UHC:1248
