JUSTICE A. GUNESHWAR SHARMA ORDER 08.09.2025 [1] Heard Mr. Niraj Bobby Paonam, learned counsel for the petitioners, Mr. S. Niranjan, learned GA for the respondent nos. 2 & 3 and none appearing on behalf of respondent nos. 1, 4 & 5 in spite of proper service of summons by speed post. [2] By the present petition, the petitioners approaching this Court for directing the official respondents to conduct the investigation of FIR No. 0180 by Sadar Kapurthala Police Station, Punjab or through the Patsoi Police Station, Imphal West, Manipur. [3] Mr. S. Niranjan, learned GA for the respondent nos. 2 & 3 has pointed out that the only prayer in the present writ petition is for investigation of FIR No. 0180 of 2024 lodged in the Sadar Kapurthala Police Station, Punjab in the Imphal or Patsoi Police Station, Imphal West. [4] The learned GA submits that the first prayer is to be made before the competent Court in the State of Punjab and the alternate prayer of investigation by the Patsoi Police Station is not permissible for an FIR registered in the State of Punjab by the State of Manipur. OINAM THOIB A MEITEI Digitally signed by OINAM THOIBA MEITEI Date: 2025.09.09 14:10:41 +05'30' [5] The learned counsel for the petitioners submits that the petitioners have never visited State of Punjab and they cannot made an accused in the State of Punjab and the learned GA has also pointed out that the summon is to appear before the Sadar Kapurthala Police Station, Punjab on 15.06.2025 and the time has already been infructuous and the cause of the writ petition does not survive. [6] The learned counsel for the petitioners has submitted that the petitioners are filing a Criminal case against the respondent no. 5 in Manipur and they never visited State of Punjab and cannot be made an accused in the case registered in the State of Punjab. [7] This Court has perused the materials on record and with the nature of the prayer conducting the investigation of FIR No. 0180 of 2024 registered in Sadar Kapurthala Police Station, Punjab in Imphal have to be prayed before the appropriate competent Court in the State of Punjab and the alternate prayer of investigation by the Patsoi Police Station, Imphal West may not be permissible as Police Station of Manipur has not jurisdiction to investigate an FIR registered in the State of Punjab. [8] With these observations, the present W.P.(C) No. 498 of 2025 is disposed of by giving liberty to the petitioners to approach before the appropriate forum to agitate their demands.
