Neutral Citation No. - 2025:AHC-LKO:35932 Court No. - 2 Case :- MATTERS UNDER ARTICLE 227 No. - 3843 of 2025 Petitioner :- Neelam Singh @ Neelam Diwan Respondent :- Vineet Sengar And 3 Others Counsel for Petitioner :- Adarsh Srivastava, Kushagra Kanodia Hon'ble Subhash Vidyarthi, J. 1. Heard Sri Adarsh Srivastava, learned counsel for the petitioner. 2. By means of the instant petition filed under Article 227 of the Constitution of India, the petitioner has sought a direction to the opposite parties to maintain status-quo till disposal of the application under Order 39 Rule 1 & 2 CPC. The petitioner has filed the aforesaid suit for perpetual injunction and she has also filed an application under Order 39 Rules 1 & 2 CPC. The Trial Court has held that it would be appropriate to hear the defendants before passing any order on the application for temporary injunction and, accordingly, on 30.05.2025, the Trial Court has issued notice to the defendants and has fixed 17.07.2025 for disposal of the application for temporary injunction. 3. When the Trial Court has issued notice to the defendant No. 2, there appears to be no illegality in the order passed by the Trial Court issuing notice for the application for temporary injunction to the defendants. Moreover, the petitioner has not challenged the validity of the order dated 30.05.2025 passed by the Trial Court. 4. In these circumstances, there is no ground for interference in the matter. The petition is dismissed accordingly. Order Date :- 19.6.2025 (Manoj K.) Digitally signed by :- MANOJ KUMAR High Court of Judicature at Allahabad, Lucknow Bench
