Neutral Citation No. - 2025:AHC-LKO:37282-DB Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 646 of 2025 Petitioner :- Shivbahadur Singh Respondent :- State Of U.P. Thru. Collector Dist. Barabanki And 3 Others Counsel for Petitioner :- Neeta Singh Chandel,Ram Naresh Singh Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Attau Rahman Masoodi,J. Hon'ble Shree Prakash Singh,J.
1. Heard learned counsel for the parties.
2. The subject matter of the present PIL is a green tree standing on the roadside. On an ocular estimation of standing green tree, it is evident that it causes an obstruction in the smooth flow of vehicles on the road. The tractors carrying load and other vehicles running on the road face a difficulty of passage, as it has branched towards the road leading to an obstruction. Such administrative issues are bound to be looked into by the administrative authorities, keeping in view the public convenience.
3. Raising a dispute in public interest for such a trivial issue does not seem to be in the spirit of PIL serving a larger interest for which such a mechanism is left open under the judicial precedents.
4. Learned counsel for the petitioner, at this stage, has prayed that he may be permitted to withdraw this PIL, leaving it for the District Authorities to look into the matter for an appropriate redressal of the local difficulties and the obstruction which the tree has caused in the smooth flow of traffic.
5. The Revenue Authorities, in consultation with the Forest Department, shall take appropriate measures and if it is so desirable to cut down the tree or prune the same, necessary measures accordingly be taken. The Revenue Authorities may also ensure that new plantation is carried out on the roadside so that flora and fauna grows on the roadside so as to maintain the ecological balance.
6. With the aforesaid observation, the present PIL is dismissed as withdrawn. [Shree Prakash Singh,J. ] [Attau Rahman Masoodi,J.] Order Date :- 2.7.2025 kkv/ Digitally signed by :- KRISHAN KUMAR High Court of Judicature at Allahabad, Lucknow Bench
