2. This application under Section 482 of BNSS, 2023 has been filed by the petitioner, namely, 1. Sri Taybur Rahman has prayed for pre-arrest bail in connection with Nagaon P.S Case No. 378/2025
registered
under
Sections 189(2)/117(2)/121(2)/308(2)/61(2)/109/174/351(2)of BNS,2023. 3. The gist of the accusation in this case is that on 07.05.2025, one complainant S.I Diganta Saloi, I/C Itapara Outpost has lodged an FIR at Nagaon PS, inter-alia, alleging that at about 4:30 PM, he along with Battalion Staff were engaged in election duty at Beltoli M.E. School as Police Sector Officer of 150 no. Lawgaon Gram Panchayat. After completion of vote, he asked the FIR named accused persons to outside the gate, then the accused persons along with 40/50 persons had beaten him up. For which he received grievous injury and had torn his uniform and taken his mobile phone and tried to rig by threatening the Presiding Officer. Hence, the case. 4. Perused the case diary. 5. The injuries sustained by the informant are simple in nature and the main accused has been granted bail by this Court vide order dated 14.08.2025 in A.B No.1624/2025. 6.
Having regard to the same, it is provided that in the event of his arrest in connection with this case, the above-named petitioner shall be allowed to go on bail of Rs.30,000/- (Rupees Thirty Thousand) only with one surety of the like amount subject to the satisfaction of the arresting authority with following
Page No.# 3/3 conditions: (i) That the petitioner shall appear before the I.O within one week from the date of this order; (ii) That the petitioner shall appear before the I.O on every fortnight till completion of investigation; (iii) That the petitioner shall refrain from such activities with which he is alleged; (iv) That the petitioner shall not exercise threats to the witnesses or tamper with the evidence and (v) That the petitioner shall not leave the jurisdiction of the Court without prior permission. 7. Send back the case diary. 8. On breach of any of the bail conditions, pre-arrest bail granted to the petitioner shall automatically stand cancelled. 9. Accordingly, this anticipatory bail petition stands disposed of. JUDGE Comparing Assistant
