A.G. assisted by Ms. Sharmila, learned counsel, appeared for respondent Nos. 1 to 3; and Mr. Lucky Boy, learned counsel, appeared for respondent No. 14. None appeared for respondent Nos. 4 to 13. The present writ petition has been filed assailing the Tentative Inter-se Seniority List of MCS Officers dated 10.02.2022 coupled with a prayer for directing the respondents to consider and dispose of the Objections dated 24.08.2016, 23.11.2017, 23.02.2022 and representation dated 02.02.2022 submitted by the petitioner against the Tentative Seniority List and to dispose of the same by issuing a speaking order. At the outset, the learned Dy. A.G., raised a preliminary objection regarding the maintainability of this writ petition. In that, a writ petition challenging the tentative seniority list is not maintainable as decided by the hon’ble Apex Court in a catena of cases. Mr. Juno Rahman, learned counsel appearing for the petitioner, fairly submitted that the present writ petition can be disposed of by directing the official respondents to finalise the Seniority List of the MCS LAIREN MAYUM INDRAJ EET SINGH Digitally signed by LAIRENMAYU M INDRAJEET SINGH Date: 2025.06.19 16:40:33 +05'30' 2 Officers within a stipulated period after considering the objection dated 23.02.2022 submitted by the present petitioner against the impugned Tentative Seniority List. The learned counsel further submitted that while issuing the Final Seniority List, the authorities be directed to issue a speaking order showing that the objections raised by the petitioner against the said impugned Tentative Seniority List has been considered on merit. In view of the submission made by the learned counsel appearing for the parties, the present writ petition is hereby disposed of by directing the respondent No. 2 to finalise the Seniority List of the MCS Officers after considering all the objections raised against the impugned Tentative Seniority List, including the objection dated 23.02.2022 submitted by the petitioner. It is made clear that at the time of issuing the Final Seniority List, the authority must pass a speaking order showing that the objections raised against the Tentative Seniority List have been considered on merit. The Whole process should be completed within a period of 2(two) weeks from the date of receipt of a certified copy of this order. With the aforesaid direction, the present writ petition is disposed of. Earlier interim order stands vacated. JUDGE Indrajeet
