For Petitioner : Mr.K.Neelamegam For R1 to R6 : Mr.M.Lingadurai Special Government Pleader For R7 : Mr.Aiyar and Dolia ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing respondents 1 to 6 to take action against the 7th respondent and remove the two high voltage towers from petitioner's land on the basis of the petitioner's representation, dated 25.03.2025. 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.17412 of 2025 2. It is seen that the 7th respondent, the Power Grid Corporation of India has erected two high voltage towers on the petitioner’s land. As per the powers vested in it, the corporation may enter into private land for such purposes and the landowners are entitled to receive appropriate compensation. 3. It is seen from the records that the petitioner has not been granted any compensation. While the petitioner has sought the removal of the high tension towers, such removal is not feasible at this stage, as the towers are put to operation. However, the petitioner is certainly entitled to compensation for the use of the land. It is also noted that the petitioner has submitted a representation dated 25.03.2025 to the 4th respondent/the District Collector. 4. Considering the facts and circumstances of the case, the 4th respondent/District Collector is directed to issue notice to both the petitioner and the 7th respondent, conduct a proper enquiry, and determine the compensation amount. Thereafter, the 7th respondent shall pay the compensation as quantified by the District Collector. This exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. As respondents 1 to 3 are not necessary parties to the present dispute, no directions are issued to them. 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.17412 of 2025 5. With the above observations, this Writ Petition is disposed of.
