GP FOR SERVICES II 2 CGR, J W.P.No.9464 of 2025 The Court made the following order: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:- “…to issue a Writ or Order more in the nature of Mandamus to declare the action of the 3rd and 4th respondents in not consider and disposing the petitioner representation dated 18.02.2025 for payment of retirement benefits as illegal, arbitrary and violation of principles of natural justice and consequentially direct the 3rd and 4th respondents to dispose the representation of the petitioner dated 18.02.2025 for settlement of his pending retirement benefits i.e., Medical benefits, Earned Leave, and Employee Provident Fund Organization Pension (E.P.F.O.Pension) and pass such other order or orders…” 2. The grievance of the petitioner is that representation dated 18.02.2025, for payment of retirement benefits is not decided by respondent Nos.3 and 4. The petitioner was appointed as driver on 13.03.1993 and his services were regularized from 01.08.1995. The 4th respondent by orders dated 01.07.2020, retired the petitioner on medical grounds upon him being declared as medically unfit for the post of Driver. Aggrieved by the same, the petitioner preferred appeal before the 3rd respondent, who upheld the aforesaid orders by proceedings dated 09.09.2020. The petitioner stated to have filed W.P.No.18845 of 2020 challenging the aforesaid order dated 01.07.2020, as confirmed by order dated 09.09.2020. However, he has withdrawn the said writ petition on the assurance given by the respondents that they would settle his monetary benefits. As the 3 CGR, J W.P.No.9464 of 2025 respondents have not done so, he submitted representation dated 18.02.2025, which is stated to be pending. Questioning the said inaction, present writ petition is filed. 3. Heard Sri Pamarthi Kameswara Rao, learned counsel for the petitioner, learned Assistant Government Pleader for Services-I for respondent No.1 and Sri Ch.Pavan Kumar, learned counsel, representing learned Standing Counsel for respondent Nos.2 to 4. 4. Learned counsel for the petitioner submits that it would suffice to direct the 3rd respondent to consider and pass appropriate orders on the representation dated 18.02.2025. 5. Sri Ch.Pavan Kumar, learned counsel, representing learned Standing Counsel for respondent Nos.2 to 4 submits that petitioner has previously filed W.P.No.18845 of 2020 seeking relief of claiming monetary benefits and also alternative employment, and by an order dated 30.06.2022, the same came to be dismissed as withdrawn without any liberty. Therefore, once again he cannot agitate the matter. He further submits that even the representation dated 18.02.2025 stated to have been given to 3rd respondent is not endorsed and disputes the submission of said representation. 6. Perused the record. 4 CGR, J W.P.No.9464 of 2025 7. This Court finds that earlier in W.P.No.18845 of 2020, which was dismissed as withdrawn, did not grant any liberty. However, the petitioner stated to have submitted representation dated 18.02.2025, claiming monetary retirement benefits alone and without any alternative employment. Since the respondents have disputed the aspect of submitting representation, the petitioner is permitted to submit fresh representation within a period of ten (10) days from today to 3rd respondent. Upon such representation, the 3rd respondent shall consider and pass appropriate orders, in accordance with law, within a period of four (04) weeks thereafter. 8. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
