1. Heard learned counsel appearing on behalf of the parties.
2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner has prayed for the following reliefs:-
"A. Issue a writ, order or direction in the nature of writ of mandamus directing and commanding the respondent nos.2, 6 and 7 to provide electric connection to the petitioner for the pumping set of 5 HP over the plot no.460 under the Pradhan Mantri Kusum Yojana pursuant to the revised Line Chart dated 13.10.2023 prepared by the respondent no.7 as earliest within specified period as fixed by this Hon'ble Court. B. Issue a writ, order or direction in the nature of writ of mandamus directing and commanding the respondent no.6 to decide the representation dated 16.01.2024 moved by the petitioner before him expeditiously within specified period as fixed by this Hon'ble Court. ..."
3. We have heard learned counsel appearing on behalf of the parties and perused the petition as well as the affidavits.
4. The factual matrix indicates that the petitioner is seeking an electric connection for his pumping set of 5 HP over Plot No.460 under the Pradhan Mantri Kusum Yojana. However, the petitioner submits that the private respondents, being the respondent Nos.8, 9 and 10 are creating hindrances in laying the electric line. This fact is also corroborated by Mr. Udit Chandra, learned counsel appearing on behalf of the Purvanchal Vidyut Vitaran Nigam Limited, the respondent No.2 herein.
5. In light of the above, we are of the view that the District Magistrate, Jaunpur, being the respondent No.3 herein, should be
directed to examine the matter and decide the right of way/alternative right of way after hearing all the relevant parties. The District Magistrate thereafter shall ensure that his order with regard to the right of way/alternative right of way is enforced and the electric connection is granted to the petitioner expeditiously. The entire exercise should be completed within a period of twelve weeks from date.
6. With the above directions, the writ petition is disposed of.
