2. The petitioner is assailing the decision of the authorities to award the road contract in favour of the respondent No. 4
3. The petitioner’s case is that the respondent No. 4 did not have the credential to participate in the tender process and despite pointing out the said fact to the authorities, the authorities have awarded the contract to the respondent No. 4, by depriving the eligible bidders like the petitioner.
4. Mr. D. Nath has submitted project completion certificate and project completion report dated 16.08.2019, issued by the Executive Engineer, PWRD, Dibrugarh, Lahowal, Moran & Tingkhong Territorial Road Division, which states that the road construction commenced on 24.05.2017 and that the same was completed on 30.07.2019
5. The project completion report and project completion certificate are made a part of the record and marked as Annexure- X & Y respectively.
6. As the respondent No. 4 has completed the contract work, in terms of the Annexure- X & Y, the matter has become infructuous and any decision made on merit will only be of academic interest. Accordingly, the writ petition stands closed as infructuous. JUDGE Comparing Assistant
