Contention of the learned counsel for the petitioner is his second appeal no. 18 of 2023 was dismissed for want of prosecution on 06.5.2025 and recall application was pending as the recall application could not be decided, therefore, this Court may direct the authority concerned to maintain status quo. This Court is of the view that the writ petition is not maintainable. Proper remedy for the petitioner is to press his recall application pending in second appeal no. of 2023.
