JUSTICE SANJAY KUMAR DWIVEDI ----- For the Petitioner : Mr. Pradeep Kumar Prasad, Advocate For the State : A.C. to Mr. Pankaj Kumar, P.P. ----- 07/11.08.2025 The petitioner is apprehending his arrest in connection with G(f) Case No.2111/2023, registered for the offence under Sections 33/41/42/52 of the Indian Forest Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Hazaribagh. 2. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent, as has been disclosed in paragraph 15 of this application. He submits that the petitioner happened to be the mason and the allegation is made that he was sitting in the tractor where forest woods were transported. 3. Learned counsel for the State opposed the prayer and submits that the allegations of taking, loading and carrying of shal woods are there and in view of that, this anticipatory bail application may kindly be dismissed. 4. Considering that the petitioner has got no criminal antecedent and it is not disclosed how the petitioner has been recognized, whereas, the allegation is made of fleeing away from the tractor and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 5. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hazaribagh in connection with G(f) Case No.2111/2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
