Neutral Citation No. - 2025:AHC-LKO:35985 Court No. - 2 Case :- MATTERS UNDER ARTICLE 227 No. - 3830 of 2025 Petitioner :- Pratima Singh And 2 Others Respondent :- Smt. Rekha Srivastava And 2 Others Counsel for Petitioner :- Ramesh Pratap Singh Hon'ble Subhash Vidyarthi,J. 1. Heard learned counsel for the petitioners. 2. By means of the instant writ petition filed under Article 227 of the Constitution of India, the petitioners have sought issuance of direction to the learned Additional Civil Judge (Senior Division), Court No.20, Lucknow for deciding their application for temporary injunction under Order 39 Rule 1 & 2 C.P.C. pending in Regular Suit No.939/2025 (Pratima Singh & others vs. Smt. Rekha Srivastava & Others) expeditiously. 3. The said application was filed by the petitioners on 08.05.2025 and the trial court had passed an order on the application for temporary injunction that it would be appropriate to hear the defendants also before deciding the application. The Court had issued notice to the defendants. 4. There is nothing on record to indicate that the petitioners have taken steps for service of notice of the application of temporary injunction upon the defendants and whether the defendants have been served with the notice and they have put in appearance before the trial court or not. 5. In these circumstances, no direction can be issued to the trial court for deciding the application. 6. The petition lacks merit and the same is dismissed at this stage. (Subhash Vidyarthi, J.)
