And 7 Others Counsel for Petitioner :- Upendra Kumar Sagar Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Heard learned counsel for the petitioners and learned Standing Counsel for the State.
2. The dispute raised in the present writ petition is essentially in the nature of a civil dispute, for which, jurisdiction would lie before the competent civil court. A preliminary objection has been raised by the opposite parties to this effect.
3. The aforesaid fact has not been disputed by the
learned counsel for the petitioners. However, he has submitted that it is on account of vacations that the present writ petition has been filed before this Court during the vacation period. Vacation courts are available in the District Courts as well, for which specific provision is made under the General Rules (Civil). Once the vacation courts are available during vacations at the district level, there is no reason for us to entertain the present writ petition under the extraordinary jurisdiction of this Court under Article 226 of the Constitution of
India.
4. The writ petition is declined to be entertained with liberty to the petitioners to avail the appropriate remedy before the competent court. If any such proceeding is initiated, the competent court is expected to decide the application for interim injunction expeditiously, in accordance with law.
