We have gone through the report of the Chief Judicial Magistrate dated 18.04.2025 wherein it has been reported that the appellant Rejesh Kumar Mishra died during the pendency of the appeal. The confirmation of his death has been made by two members of his family, Sub-Inspector of concerned Police Station and Gram Pradhan of the Gram Sabha concerned. Since the sole appellant had died, the appeal stands abated. Though the appeal has been abated today, the trial Court record shall not be sent back as it is required for decision in the connected Criminal Appeal No.855 of 2016.
