Neutral Citation No. - 2025:AHC-LKO:35989 Court No. - 2 Case :- WRIT - A No. - 6826 of 2025 Petitioner :- Mangaru Ram Chauhan Respondent :- State Of U.P. Thru. Addl. Chief Secy. Medical And Health Services U.P. Lko. And 5 Others Counsel for Petitioner :- Prahlad Maurya,Anam Som Ratna Maurya Counsel for Respondent :- C.S.C. Hon'ble Subhash Vidyarthi,J.
1. Heard Sri Prahlad Maurya, learned counsel for the petitioner and Sri Raj Bux Singh, learned Additional Chief Standing Counsel for State-respondents.
2. By means of the instant writ petition, the petitioner has challenged validity of orders dated 13.12.2024, 24.04.2025 and 20.05.2025 passed by the opposite party Nos.2, 5 and 4 respectively whereby his pension has been reduced as a consequence of re-fixation of his salary with retrospective effect.
3. Learned Additional Chief Standing Counsel has raised the preliminary objection that a claim petition bearing No.280/2025 filed by the petitioner is pending before the State Public Services Tribunal (hereinafter referred to as "Tribunal") and the petitioner should raise this grievance also before the Tribunal.
4. As the petitioner's claim petition is already pending before the Tribunal, this Court finds no good ground to entertain the writ petition and the petitioner is at liberty to take appropriate steps for assailing the impugned orders before the Tribunal.
5. The writ petition is, accordingly, disposed of. (Subhash Vidyarthi, J.) Order Date :- 20.6.2025 Shubhankar Digitally signed by :- SHUBHANKAR THAKUR High Court of Judicature at Allahabad, Lucknow Bench
