GP-MUNCIPAL ADMN AND URBAN DEV(AP) The Court made the following: 2 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue an appropriate Writ order or direction, more particularly a writ in the nature of Mandamus directing the respondents to consider representation dated 18.4.2016 which was sent under registered post with acknowledgement due before according any permissions to the private parties for establishing Dumping Yard and also Solid Waste Management Energy Plant in the aforesaid villages without knowledge and consent of aforesaid villagers and gram Panchayats which have elected bodies represented by the people of the villages….” 2. Today when the matter came up for hearing, learned counsel for the petitioners reiterated the contentions urged in the Writ Petition, but, however limited his request to direct the respondent authorities to dispose of the representation submitted by the petitioners on 18.04.2016, opposing the establishment of a Garbage Dumping Yard in Sy.Nos.13, 14 and 15 of Mucherla Village, S.No.213 of Gidijala village and Sy.No.1 of Tarluvada village for the garbage generated within the limits of Greater Visakhapatnam Municipal Corporation. 3. On the other hand, learned Standing Counsel appearing for respondent Nos.2 and 3 submits that the respondent authorities will consider the representation submitted by the petitioner, dated 18.04.2016 and will pass appropriate orders in accordance with law, if not yet disposed of. 4. Having regard to the facts and circumstances of the case and submissions made by the learned counsels, instead of going into the merits of 3 the case, this Court feels it appropriate to dispose of the Writ Petition by directing respondent Nos.2 and 3, to consider the representation made by the petitioner dated 18.04.2016 and pass appropriate orders, if not yet passed, in accordance with law, within a period of four (04) weeks from the date of receipt of a copy of this order. 5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
