1. Heard Mr. M. I. Hussain, learned counsel for the petitioner Saddam Ali.
2. The petitioner has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind bars since 28.04.2025 in connection
Page No.# 2/3 Pragjyotishpur P.S. Case No. 58/2025 under Section 69 of the BNS.
3. Heard Mr. P. Borthakur, learned Additional Public Prosecutor for the respondent State.
4. The allegation against the petitioner is that the petitioner induced the victim to have physical relationship with him and he impregnated the victim. At present, the petitioner is denying paternity of the victim's child and he has also threatened to eliminate her.
5. Case Diary is not received.
6. The petitioner is behind bars for 57 days. It appears that investigation may have presumably progressed and further custodial detention may not be required.
7. I have considered the submission that the petitioner is willing to co-operate with the remaining part of investigation and to abide by any stringent bail conditions if imposed upon him.
8. Considering all aspects, petition is allowed. The petitioner shall be enlarged on bail on furnishing a bail bond of Rs.50,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, (M) under the conditions that: (i) The petitioner shall co-operate with the remaining part of investigation, (ii) The petitioner shall appear before the Investigating Officer every fortnight till completion of investigation, (iii) The petitioner shall not exercise threats to the witnesses or try to influence the witnesses, and
Page No.# 3/3 (iv) The petitioner shall not leave the jurisdiction of the Court without prior permission.
9. On breach of any of the bail conditions, the learned Court is at liberty to immediately cancel the bail granted to the petitioner.
10. In terms of the above observation, this petition stands disposed of.
