Neutral Citation No. - 2025:AHC-LKO:36993-DB Court No. - 2 Case :- WRIT - C No. - 5899 of 2025 Petitioner :- Mohammad Rafeek Respondent :- District Magistrate Distt. Amethi And 20 Others Counsel for Petitioner :- Onkar Singh Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. The petitioner has already initiated proceedings for cancellation of patta which according to him has been illegally granted to the private opposite party, that too, in respect of a land which in fact, as claimed, is his bhoomidhari land, therefore, it is in those proceedings that he should seek interim relief rather than filing this writ petition. If any such application is filed, it would be considered by the competent authority under Section 66 of the U.P. Revenue Code, 2006 at the earliest say within a period of one week of submission of such application, and requisite orders shall be passed as per law. We have not at all adjudicated the veracity of the averments made by the petitioner nor have we considered the submission of the Standing Counsel that in fact, the patta has been granted in respect of a land of which the petitioner is not a bhumidhar but is interfering in the said land. All this will be seen by the competent authority under Section 66 of the U.P. Revenue Code, 2006. The writ petition is accordingly disposed of.
