Neutral Citation No. - 2025:AHC-LKO:35742-DB Court No. - 1 Case :- WRIT - C No. - 5898 of 2025 Petitioner :- Roop Lal And 2 Others Respondent :- District Magistrate Unnao And 10 Others Counsel for Petitioner :- Durga Prasad Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Heard learned counsel for the petitioner and learned Standing Counsel for the State.
2. The writ of mandamus in the present case has been sought on the premise that an order of status quo was passed in favour of the petitioner in relation to the land in dispute regarding which the partition proceedings were kept in abeyance on account of some survey being going on to demarcate the villages.
3. Once an order of status quo was passed by the Assistant Record Officer marking it to Revenue Inspector, Lekhpal and SHO, the petitioner ought to have approached the authorities concerned and brought the said order to their knowledge. The petitioner approached this Court without making any representation before the authorities concerned. It is a prerequisite for seeking a writ of mandamus to approach the competent authority first and such a requirement has not been fulfilled by the petitioner before instituting the present writ petition.
4. We leave it open to the petitioner to approach the competent authority for necessary action in the matter, however, the prayer made prematurely is declined to be entertained.
5. The writ petition is accordingly disposed of with the liberty as above. . [Subhash Vidyarthi,J.] [Attau Rahman Masoodi, J.] Order Date :- 18.6.2025/kanhaiya Digitally signed by :- KANHAIYA KUMAR High Court of Judicature at Allahabad, Lucknow Bench
