Present bail application has been moved by the applicant, who is in judicial custody in connection with Case Crime No.16 of 2025 under Section 103(1) read with Section 3(5) of Bhartiya Nyaya Sanhita, 2023 registered at Police Station Dhanchula, District Pithoragarh. 4. Heard Mr. Bhupendra Singh Bhandari, learned counsel for the applicant and Mr. K.S. Bora, learned Deputy Advocate General for the State. 5. Learned counsel for the applicant submits that there is no motive or mens-rea shown against the applicant; there is no reliable evidence against the applicant except the confessional statement; no recovery has been made from the applicant. He submits that applicant is a young individual and is the sole bread earner of his family and in case he is languishing in jail his family will be at the verge of starvation. 6. Learned State counsel has opposed the bail application. 7. Having heard the learned counsel for the parties and considering the overall facts and circumstances of the case, without going into the merits of the case, this Court is of the view that applicant deserves bail. 8. Accordingly, the bail application is allowed. Let the applicant-Ramesh Singh be released on bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of court concerned.
