It is agreed between the counsel for private parties that the matter is covered by an earlier decision of this Court in Writ-A No. 58005 of 2017 (Hari Om Yadav Vs. State of U.P. and 3 others) decided on 11.9.2019. Special Appeal filed against that order being Special Appeal Defective No. 950 of 2020 (State of U.P. And 3 Others Vs. Hari Om Yadav) is also shown to have been dismissed vide order dated 21.10.2020. SLP therefrom is also shown to have been dismissed vide order dated 31.8.2021. At present, the petitioner claims complete parity with the said Hari Om Yadav (supra). In view of the similarity of facts shown, the order dated 6.7.2017 is quashed and the present writ petition shall stand disposed of in terms of the decision in Hari Om Yadav (supra).
