The present Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant seeking anticipatory bail under Sections 316(2), 318(4), 336(3), 338 and Section 340(2) of the Bharatiya Nyaya Sanhita, 2023 in Case Crime No.484 of 2024, registered at Police Station Rudrapur, District Udham Singh Nagar. 2. As per the First Information Report, Vishal Singh and Smt. Sweety Singh (named accused) took a loan from the informant Bank on the basis of forged documents. 1 2025:UHC:9704 3. Heard Mr. Vikas Kumar Guglani, learned counsel for the applicant and Mr. Sandeep Sharma, learned Assistant Government Advocate for respondents. 4. Mr. Vikas Kumar Guglani, Advocate, contended that the applicant is not named in the First Information Report. He has been falsely implicated in the present matter. He was working in the informant bank as Officer Grade III. He had no exclusive authority to approve, sanction and disburse the loan amount to the borrowers. The co-accused Girish Chandra Pandey, the then Branch Manager, has already been granted anticipatory bail in Anticipatory Bail Application No.290 of 2025. The applicant has no criminal antecedents. Charge-sheet has already been filed, therefore, there is no chance of tampering with the evidence, and, applicant was granted interim bail on 19.03.2025, and, the conditions of interim bail have not been violated by him. 5. Mr. Sandeep Sharma, learned Assistant Government Advocate, has opposed the anticipatory bail application. 6. Personal liberty under Article 21 of the Constitution of India is very precious fundamental right 2 2025:UHC:9704 and it should be curtailed only when it becomes imperative according to the peculiar facts and circumstances of the case. 7. Having heard the submissions of learned counsel for the parties and keeping in view of the facts and circumstances of the case, without commenting on the merits of the case, the present Application, filed for anticipatory bail, is allowed and order dated 19.03.2025, granting interim bail to the applicant, is made absolute. It is directed that in the event of arrest of the applicant Navneet Kumar Pandey, he shall be released on anticipatory bail on executing a personal bond of Rs. 30,000/-and two reliable sureties, each of the like amount, to the satisfaction of the Arresting Officer, subject to the following conditions:- (i) Applicant shall attend the trial court regularly and he shall not seek any unnecessary adjournment; (ii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person, acquainted with the facts of this case; (iii) Applicant shall not leave the country without the previous permission of the trial court. 8.
