This is the Second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who have been arrested in connection with Crime No. 314/2024 registered at Police Station : Padmanabhpur, District Durg, for the offence punishable under Section 108 of Bharatiya Nyaya Sanhita, 2023 and Sections 67 and 67(a) of Information Technology Act. 2. As per the prosecution case, in brief, is that on 08.08.2024, at approximately 8:30 a.m., the applicant used mobile numbers 87705007508 and 9238313896 to send an obscene video of the PREETI KUMARI Digitally signed by PREETI KUMARI 2 deceased to Shreyas Sinha's mobile number i.e. 7448131883. When the deceased requested that the applicant to delete the video, the applicant allegedly blackmailed her by threatening to make the video viral. As a result, the deceased, under immense mental stress, took her own life by hanging herself with her sky-blue scarf. On the above background, the case has been registered against the applicant, leading to this bail application. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He further submits that the first bail application was rejected by this Court vide order dated 07.11.2024 passed in MCRC No. 7685/2024 on merits. He further submits that out of 21 prosecution witnesses, statement of 06 witnesses have been recorded including the parents of the deceased and it is stated that applicant is in jail since 18.08.2024 and the charge-sheet has been submitted. Therefore, he prays that the applicant may be enlarged on bail. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that against the rejection of the first bail application, the applicant had preferred an SLP, and the same was dismissed by the Hon'ble Apex Court vide order dated 27.01.2025, the copy of the same has been annexed at A/3 in this bail application. As the First bail was rejected on merits and the said order was also confirmed by the Hon'ble Apex Court, hence, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact and circumstances of the case and the fact that the first bail application was rejected by this Court on merits vide 3 order dated 07.11.2024 passed in MCRC No. 7685/2024, thereafter, the applicant had preferred an SLP, and the same was dismissed by the Apex Court vide order dated 27.01.2025, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant – Akash Singh involved in Crime No. 314/2024 registered at Police Station : Padmanabhpur, District Durg, for the offence punishable under Section 108 of Bharatiya Nyaya Sanhita, 2023 and Sections 67 and 67(a) of Information Technology Act, rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
