This application under Section 482 Cr.P.C. has been filed for quashing of the entire proceeding of Complaint case No. 28958 of 2022:Preeti Pandey Vs. Harpeet Singh, under Section 138 of Negotiable Instruments Act, 1881, Police Station Aliganj, District Lucknow, pending the court of Presiding Officer, Additional Court No.05, Lucknow as well as non-bailable warrant order dated 30.11.2024, 20.01.2025 and 20.03.2025 passed by Presiding Officer, Additional Court No.5, Lucknow. Learned counsel for the applicant submits that the applicant could not appear before the trial court, non-bailable warrant has been issued he undertakes to appear on the next date before the trial Court, which is 03.07.2025. Subject to appearance of the applicant before the trial court on 03.07.2025, non-bailable warrant shall not be executed against the applicant. However, in case the applicant does not appear on the said date, non-bailable warrant shall be executed against him. With the aforesaid observations/directions, the application stand disposed of.
