Mr. Saurabh Kumar Pandey, learned counsel for the petitioner. 2. Mr. Suyash Pant, learned Standing Counsel for the State of Uttarakhand. 3. Mr. Ashish Joshi, learned counsel for the respondent-HRDA. 4. Petitioner applied for compounding of a non-residential building to Haridwar- Roorkee Development Authority (HRDA). His application was rejected by the Competent Authority, vide order dated 20.11.2025. Thus, feeling aggrieved, petitioner has approached this Court. 5. Learned counsel for the petitioner submits that although the order impugned is appealable before the Chairman, HRDA, however, on account of Lawyers strike, petitioner is not able to file appeal. 6. Learned State Counsel, however, submits that Lawyers of Haridwar are not on strike, and as per his information, some Lawyers, practicing at Dehradun have abstained from work on account of their demand regarding Chamber. Thus, he submits that excuse taken by petitioner for not approaching the Appellate Authority is factually incorrect. 7. Be that as it may, when the petitioner has remedy of appeal, therefore, this Court is not inclined to 2025:UHC:10523 entertain this petition. 8. As per the Statute, limitation of 30 days is available to petitioner. Since appeal filed by petitioner would be within time upto 20.12.2025, therefore, the writ petition is disposed of by providing that no coercive action shall be taken against the petitioner till 20.12.2025. If petitioner files appeal against the rejection of his compounding map, the same shall be considered, as early as possible. However, petitioner shall not raise any construction over the land in question and he shall have to submit an undertaking in the form of an affidavit to that effect.
