1. Mr. Vikas Singh Yadav and Mr. Gaurav Singh, learned counsel for the applicant.
2. Mr. Pankaj Joshi, learned A.G.A. for the State.
3. The present applicant-Nasir is seeking bail in relation to Case Crime No. 0004 of 2025, arising out of FIR dated 02.01.2025 registered at P.S. Bhagwanpur District Haridwar wherein the present applicant has been implicated for the offence punishable under Section 8/20 of the NDPS Act.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated and the alleged contraband which was shown to be recovered from the applicant is 510 gm. charas which is below the commercial quantity.
5. Apart from this, learned counsel for the applicant submits that there is no compliance of the mandatory provision of NDPS Act. He further submits that the applicant has no previous criminal history.
6. On instructions, learned A.G.A. submits that the applicant has no previous criminal history and he also apprised this Court that charge sheet has been filed, therefore, there is no need of custodial interrogation.
7. After hearing arguments of the
learned counsel for the parties, and after gone through the papers on record, this Court is of the view that since the applicant has no previous criminal
2025:UHC:1529 history and alleged contraband which is recovered from the applicant is below the commercial quantity, this Court is of the view that the applicant deserves for bail.
8. Accordingly, without expressing any opinion on the merits of the case, the bail application is allowed.
9. Let the applicant- Nasir be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
10. It is made clear that the applicant will cooperate with the trial and will not seek unnecessary adjournment and if the applicant is found to be involved in any criminal activity the prosecution immediately move an application for cancellation of bail.
