KEMPAIAH SOMASHEKAR ORDER 19.08.2025 [1] This contempt case has been initiated by the petitioner in respect of the orders rendered by the writ court in WP(C) No. 1014 of 2015 dated 09.05.2019 but in this contempt case seeking for intervention for taking action against the respondents/accused. [2] Learned senior counsel Mr. Ch. Ngongo is on record as counsel for the complainant/petitioner but there is no representation either through video conferencing or present before the court physically. [3] Whereas, the learned senior counsel Mr. M. Devananda for the respondents in this matter is present and wherein the said senior counsel is appraising the order dated 17.04.2023 in the proceeding in Review.Pet. No. 3 of 2023 arising out of the proceeding in WP(C) No. 1014 of 2015 and whereby the learned senior counsel appraising to consideration of para No. 10 which indicates that the Court is inclined to pass certain orders as clause (a), clause (b), clause (c) and clause (d). No. 3 of 2023 indicates that the Deputy Commissioner, Imphal West shall consider the objection made by the respondent/writ petitioner and pass a final order in accordance with law within a period of 12 (twelve) weeks from the date of receipt of explanation submitted by the writ petitioners. [4] However, keeping in view the scope of Section 2(b) of the Contempt of Courts Act, 1971 even for initiation of this proceeding and also keeping in view the provision of Section 12 of the Act and more so clause (c) of the order dated 17.04.2023 rendered in Review.Pet. No. 3 of 2023 are concerned, it is deemed appropriate that this contempt proceeding does not survive for consideration and consequently, this contempt proceeding is hereby closed. CHIEF JUSTICE Sushil
