He admitted to carrying ganja in the backpack. A memorandum statement of Kamlesh Sahu was recorded in the presence of witnesses, where he stated that he was carrying ganja in motorcycle with accused Rajkumar Sahu. The seized ganja weighed 7.220 kilograms. During the investigation, co-accused Rajkumar Sahu was arrested and revealed that he purchased the ganja for ₹49,000/- and was caught by the police while transporting it. 3. Learned counsel for the applicants submits that the present applicants are innocent and have been falsely implicated in the present case. He further submits that from the joint possession of the applicants intermediate quantity of the psychotropic substance ganja has been seized, and therefore, it will not attract the rigors of Section 37 of the NDPS Act as the commercial quantity of ganja as prescribed under the schedule is more than 20 kgs and from the joint possession of the applicants only 7.220 kgs of contraband article has been seized. He further submits that the co-accused has already been granted bail by this Court in MCRC No. 1615/2025 vide order dated 20.03.2025 and the applicants are in jail since 13.01.2025 and 18.01.2025 respectively and the conclusion of the trial is likely to take quite long time.
